Terms of Service

Fealty ("Fealty", "we", "us") is a Discord bot, a Telegram bot and a web app for NFT and web3 communities: holder verification and roles, points and levels, quests, raffles and allowlists, collab templates, public profiles, sales and floor posts, and support tickets. These terms are a binding agreement between you and Fealty. You accept them when you sign in, add the bot to a server, connect a Telegram group, create a community, or otherwise use Fealty. If you do not agree, do not use Fealty.

Fealty is in beta. Features, limits and prices change often, and some features may be paused or removed. The Privacy Policy explains how we handle personal data and is part of these terms. Contact for everything in these terms: support@fealty.club.

You must be at least 13 years old, or older where your country requires it, and you must follow the terms of Discord, X and Telegram when you use them with Fealty. You must be at least 18, or the age of majority where you live, to link a wallet, connect an X account, enter raffles, pay for anything, join the referral program or take part in the Genesis Pass.

You can sign in with Discord, with X, or with a wallet you already linked; each one you connect opens the same account. Keep one account per person, keep your sign-in methods secure, and tell us at once if you think someone else is using your account. If you connect a Discord or X account that already belongs to another Fealty account, we offer to merge the two; we never move data between accounts silently.

You may not use Fealty if you are subject to sanctions, or if you are in a place where using Fealty, holding crypto assets or paying in them is prohibited. You are responsible for following the law where you live.

If you add Fealty to a Discord server, connect it to a Telegram group, or create a web community, you confirm that you are allowed to act for that community and to accept these terms for it. The owner decides how Fealty is set up: collections, roles, quests, raffles, channels and who is on the team. In a Discord server, members with the Administrator permission can manage Fealty automatically, so the owner controls who can manage it by controlling who is an administrator there.

Member data you receive

Your team can see and export data about your members: entries and winners (Discord name and ID, X handle, wallet addresses, and email when your raffle asks for it), points and levels, and holder context in support tickets. You may use it only to run your community, pick and deliver prizes, and support your members. You are responsible for it once it leaves Fealty: keep it secure, follow the privacy laws that apply to you, do not sell it, and do not use it to spam or contact people for unrelated purposes. Data you upload yourself (for example member lists imported from another tool) must be data you are allowed to share with us.

Leaving Fealty

You can remove the bot from your server at any time. A server's data is kept for 30 days after the bot leaves, so adding it back restores everything; after that the server's community data is deleted. Invoices, payment records, referral records and any credit you bought are kept. The owner of a web community can delete it from its settings at once, unless it has paid invoices, in which case support closes it.

Communities run their own raffles and quests on Fealty. The community is the organizer: it sets the prize, the requirements, the odds and the rules, and it is responsible for delivering prizes and for following the law on promotions, giveaways and prize draws where it runs them. Fealty provides the tools: it checks requirements, draws winners at random using the odds the community set, and shows results. Fealty does not sponsor, hold or deliver prizes and is not a party to any arrangement between a community and its members.

• Entering a raffle never costs money on Fealty. A community may ask for points, which have no cash value.
• Requirements are checked when you enter, at the draw, or both, depending on the requirement. Holdings are read from public blockchains at the draw.
• Requirements on X (follows, likes, reposts, replies) are checked against what X shows us. If X does not show an account (for example because it is protected, limited or suspended), that account cannot be verified and does not qualify.
• A draw is final once made, except where the community redraws a winner it disqualified, for example for not meeting a requirement or for abuse.
• Raffles are void where prohibited.

Points, XP, levels, roles and leaderboard ranks belong to the community they were earned in. They have no monetary value, cannot be sold, transferred or exchanged for money, and communities may change, reset or remove them.

FEALTY IS NON-CUSTODIAL. LINKING A WALLET IS A ONE-TIME, OFF-CHAIN MESSAGE SIGNATURE THAT PROVES YOU CONTROL AN ADDRESS. WE NEVER ASK FOR TRANSACTION APPROVALS TO LINK A WALLET, NEVER HOLD OR TRANSFER YOUR ASSETS, NEVER RECEIVE PRIVATE KEYS OR SEED PHRASES, AND CANNOT START ANY TRANSACTION FROM YOUR WALLET.

The only transactions you ever sign for Fealty are ones you start yourself: paying an invoice, or minting or redeeming a Genesis Pass. Anyone asking you to share a seed phrase, approve a transaction or "validate" a wallet in Fealty's name is a scammer. We never contact you first to ask for a signature or a payment.

Business plans are bought per community. The pricing page lists each plan, its price and its limits, which the product enforces. You pay in USDC on one of the networks offered at checkout: we create an invoice for the exact amount, valid for 72 hours, and the plan starts once the payment is confirmed on-chain, normally within minutes.

Blockchain payments are irreversible and have no chargebacks. Send the exact amount, in USDC, on the invoice's network, from a wallet linked to your account; a payment sent another way may not match automatically, in which case contact support with the transaction hash and we will find it. Network fees and any taxes on your purchase are yours. USDC is a third-party stablecoin whose issuer and value we do not control. We may refuse or hold payments from sanctioned or high-risk addresses.

Plans do not renew automatically. Changing plans in the middle of a term converts the time you have left into the new plan by price, in either direction, so you never lose paid value. When a plan ends it keeps working for a 7-day grace period; then the community returns to the free tier, anything over the free limits pauses, and your setup is kept and comes back when you renew.

Fealty Pro is an individual plan for your own account, sold monthly or yearly at the price shown on your account page and paid like a Business plan. It does not renew automatically; months you buy are added to any time you already have. When it ends, nothing is deleted: its features (such as auto-claim and alerts) simply pause.

We may also give Fealty Pro for free, for example as a grant, a promotion or by redeeming a Genesis Pass. Free Pro lasts only as long as its offer says and while its conditions are met, and we may change or end such offers at any time. Time you paid for is never affected by that.

By creating an invoice and paying it you ask us to start the service as soon as the payment confirms, and you acknowledge that you lose any statutory right of withdrawal once the paid term has been fully performed. Subject to the paragraph below, payments are final and non-refundable.

Nothing in these terms limits rights that the law of your country gives you as a consumer and that a contract cannot remove. If you are a consumer in the EU or the UK and withdraw within 14 days of buying, we refund the part of the term not yet used, pro rata. Engagement credit is used up when reads are made, and used credit is not refundable. Business plans are bought to run a community or business; if we ask, you confirm in which capacity you bought.

Checking engagement on X costs money, so each community holds prepaid engagement credit in US dollars. Checks are normally charged at the official X API list price; Fealty may charge less for a time (a discount or a campaign) or cover a check entirely, and the Usage page shows the price in force and what each read cost. A new community gets $10 of credit once. Business plans include a monthly allowance that is used first, resets every month, does not roll over and ends with the plan. Credit you buy yourself never expires. When credit runs out, the features that need it (quests and X checks in raffles) pause until credit is added.

Credit can only be spent inside Fealty, on the community that holds it. It cannot be transferred, cashed out or exchanged for crypto assets, earns no interest, and is not electronic money, a deposit or an investment.

A community that arrives through a referral can get a free trial of a Business plan, once per community, with trial credit while our monthly budget for trials lasts. Trials and other promotions are offered at our discretion and may change or end at any time. Creating communities or accounts to collect trials, free credit or rewards more than once is not allowed, and we may remove what was collected that way.

Anyone 18 or older with a Fealty profile and a linked EVM wallet can join the referral program by accepting its terms on the referrals page. Those terms are summarised here:

• You earn 10% of a referred community's first plan payment, once per community. Credit purchases and later payments do not earn commission.
• A community is referred when its owner opens your link (remembered for 60 days) or enters your code at checkout, and its first plan payment must come within 12 months of that.
• There is no commission on a community you own, run or pay for yourself, including a payment sent from your own wallet. We may void any referral we find abusive, such as fake communities, self-referral through other accounts, or misleading promotion.
• Commission is paid in USDC, normally within 7 days of the payment clearing, to a linked wallet you choose on a supported network. You are responsible for any taxes on it, and we may ask for information we need to pay you lawfully.
• Promote Fealty honestly: do not spam, do not present yourself as Fealty or as speaking for it, and do not make promises about Fealty that it does not make. You are an independent participant, not our employee, agent or partner.
• We may change or end the program. Commission already earned under the terms in force when it was earned is still paid, unless it was earned through abuse.

The Genesis Pass is a digital collectible on Ethereum that can be redeemed in Fealty, as described on the Genesis page for each season (for example for months of Fealty Pro or of a Business plan). Minting is free apart from network fees, which you pay.

• Joining the waitlist or completing tasks does not guarantee an allowlist spot or a pass. Supply is limited and we decide who gets spots; we may refuse anyone who uses bots, multiple accounts or other abuse.
• A pass is a utility item for use in Fealty, not an investment, a security, a share in Fealty or a promise of any return. We do not promise that a pass will have any market value, and we do not run a market for it.
• Minting, transferring and redeeming are on-chain transactions you start yourself. They are irreversible and carry the usual risks of smart contracts and blockchains.
• What a pass can be redeemed for is set when its season is announced. We may set different benefits for later seasons, but we will not take away the benefit of a pass that is already minted, except where the law requires it.

What you put into Fealty stays yours: names, images, logos, text, collab templates, profile details and prize descriptions. You give us a worldwide, royalty-free licence to host, copy, resize and display it as needed to run and promote the service, for as long as it is in Fealty. You confirm that you have the rights to what you upload and that it is lawful. Images you upload are publicly reachable by link.

Collab templates and published profiles are public. Keep them truthful: do not claim work, results or affiliations you do not have, and do not impersonate a project or a person. When you import data (for example raffles from another tool), you confirm you are allowed to use it. Endorsements are the personal view of the person who wrote them. When a community requests a spot through a template, its request and contact details go to the template's owner and team.

We may remove content, unpublish a profile or archive a template that breaks these terms or the law. If you believe something shown in Fealty infringes your rights, email support@fealty.club with the material, where it appears, your contact details and a statement that you believe in good faith it is infringing. We remove infringing material and end the access of repeat infringers. Feedback you send us may be used freely.

You agree not to:

• break the rules of Discord, X or Telegram through Fealty, or fake engagement with bots, bought interactions, or coordinated inauthentic activity;
• use multiple accounts, fake communities or automation to win raffles, collect trials, credit, rewards or referral commission;
• run lotteries or paid-entry draws, or offer prizes that are unlawful where you run them;
• use Fealty for scams, phishing, impersonation, harassment, spam, money laundering, sanctions evasion, or offering investments or securities;
• probe, scrape, overload or disrupt the service, get around its limits, or access accounts, communities or data that are not yours (report security issues to support instead);
• exploit bugs or pricing errors, or resell or white-label Fealty without our written consent.

We may investigate breaches and suspend or end access because of them, and we may void entries, wins, points, credit or commission obtained through them.

Fealty depends on Discord, X, Telegram, public blockchains and the services that read them. We do not control these platforms; their outages, limits and policy changes can affect Fealty, and your use of them is governed by their own terms. Fealty is not affiliated with or endorsed by Discord, X, Telegram, any marketplace, or any NFT project shown in the service. NFTs and tokens shown in Fealty are not our products, and nothing in Fealty is financial, investment, tax or legal advice.

You can stop using Fealty at any time. You can delete your account yourself from your account page: your personal data is deleted, while raffles and quests you created stay with their communities under "Deleted account", your wins in raffles already drawn keep only the delivery wallet, and payment records are kept as the law requires. If you own a web community, delete it first; if referral commission is still owed to you, it is paid first.

We may suspend or end your access, or a community's, with notice where we reasonably can, if you seriously or repeatedly break these terms, create legal or security risk, or where the law requires it. If we end a paid term without such a reason, we refund the unused part pro rata. Sections 13 and 17 to 22 continue to apply after access ends.

FEALTY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT FEALTY WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ROLES, HOLDINGS, ENGAGEMENT OR OTHER DATA WILL ALWAYS BE CURRENT OR COMPLETE, OR THAT ANY BLOCKCHAIN OR THIRD-PARTY PLATFORM WILL WORK CORRECTLY. SOME COUNTRIES DO NOT ALLOW CERTAIN EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST PRIZES OR ALLOWLIST SPOTS, OR LOSS OF DIGITAL ASSETS. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT FEALTY IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) 100 US DOLLARS. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT THE LAW DOES NOT ALLOW TO BE EXCLUDED, SUCH AS FOR FRAUD, OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

If you use Fealty for a community or business you run, you will defend us against, and cover our losses from, third-party claims arising from your content, your raffles, prizes and promotions, your handling of member data, your breach of these terms, or your breach of the law or of others' rights. This does not apply where consumer law prohibits it.

If something goes wrong, write to support@fealty.club first; both sides agree to try to settle any dispute informally before starting formal proceedings, and most issues are resolved within days. If you are a consumer, nothing in these terms limits the mandatory protections of the law of the country where you live or your right to bring a claim in its courts.

We may update these terms as Fealty changes; the date at the top shows the latest version. For changes that materially affect you, we give notice on this site or in the service before they take effect, unless the change is needed at once for legal or security reasons. Continuing to use Fealty after a change takes effect means you accept it; if you do not, stop using Fealty and, if you wish, delete your account.

If a provision of these terms cannot be enforced, the rest still applies. Not enforcing a provision is not a waiver of it. You may not transfer these terms without our consent; we may transfer them to a successor that continues to run Fealty and will announce it. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of Discord, X, Telegram, blockchains or hosting providers. We send notices through the service or this site. These terms, the pricing page and the Privacy Policy are the whole agreement between you and Fealty about the service. If these terms are translated, the English version prevails.
